Withdrawal

1. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which the contract was concluded.

To exercise your right of withdrawal, you must inform us

by means of a clear statement, for example a letter sent by post or an email, of your decision to withdraw from this contract. You may use the model withdrawal form set out below or the online form on this page, but neither is mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

2. Consequences of withdrawal

If you withdraw from this contract, we must reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this reimbursement.

3. Early expiry of the right of withdrawal (digital services)

In the case of a contract for the supply of digital services, your right of withdrawal expires early only if all of the following conditions are met:

1. 1.you have expressly consented to us beginning to perform the service before the end of the withdrawal period, and
2. 2.you have acknowledged your awareness that by giving this consent you lose your right of withdrawal once performance of the contract begins, and
3. 3.we have begun to perform the contract.

4. Early expiry of the right of withdrawal (digital content)

In the case of a contract for the supply of digital content that is not supplied on a tangible medium, your right of withdrawal expires once we have begun to perform the contract after you have

1. 1.expressly consented to us beginning performance before the end of the withdrawal period, and
2. 2.acknowledged your awareness that by giving your consent you lose your right of withdrawal once performance begins, and
3. 3.we have provided you with a confirmation pursuant to Section 312f of the German Civil Code (BGB).

5. What this means for you

The early expiry of your right of withdrawal occurs only where the statutory conditions set out above are met in full, that is, your express consent to performance beginning immediately, your acknowledgement that you are aware of losing the right of withdrawal, and the actual start of performance. Where those conditions are not met, your fourteen day right of withdrawal continues to apply.

6. Compensation for value in the case of digital services

If you requested that the digital service should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point at which you notify us of your withdrawal, compared with the total scope of the services provided for under the contract.

7. Model withdrawal form

If you wish to withdraw from the contract, you may complete this form and return it to us. Using it is voluntary.

8. Submit a declaration online

For convenience, you can submit your withdrawal declaration directly here. This form is one option among several and is not mandatory. A withdrawal is not subject to any particular form: a clear statement by email to hello@elessarhealth.com, by letter to the address given above, or by any other legally permitted means is equally effective.

After you submit the form, we send a confirmation of receipt to the email address you provide. It records the date and time at which your declaration reached us and repeats the declaration itself, so that you hold a record of it. The confirmation documents receipt only; it is not a decision on your declaration.
